Article 2 – Purchase Agreement

A purchase agreement is concluded once an order has been placed in our online store. As confirmation, we will send the customer an e-mail containing all order and address details as entered by the customer. Any errors or inaccuracies are entirely at the customer's own risk and expense. If you wish to cancel your order, please contact American Sportstore as soon as possible. Once your order has been handed over to the shipping carrier, cancellation is no longer possible and you must follow the return procedure.

Article 3 – Prices

All prices stated are in euros, including VAT and excluding shipping costs. American Sportstore reserves the right to change prices. Price changes will not affect orders that have already been placed.

Article 4 – Payment Method

Payment for your order must be made immediately after placing the order using your selected payment method. The total amount includes VAT and shipping costs. The total amount can be found in the shopping cart and on the order page. If you pay by credit card, the total amount (including shipping costs) will be charged to your credit card immediately. The total amount can be found in the shopping cart during checkout/secure payment.

Article 5 – Shipping Method and Costs

Orders are shipped with PostNL. In most cases, PostNL delivers orders within 1 to 2 working days. This applies to domestic shipments within the Netherlands only. Delivery times for special orders may vary (for example, custom-made orders, basketball systems and basketball poles). Shipments are always made at the seller's expense and risk. The choice of shipping method and packaging is at the sole discretion of American Sportstore. The legal delivery date is considered to be the moment you receive the goods. If PostNL is unable to deliver your package because you are not at home and the parcel is not collected from a collection point in time, we reserve the right to charge the shipping costs again for a second shipment. We also offer the possibility of delivering your order to a different address. You can specify this when entering your address details.

Article 6 – Delivery Time

The expected delivery time is stated for each product in our webshop. Unfortunately, it may occasionally happen that products are out of stock, which may result in a longer delivery time than expected.

If an item is unavailable or cannot be delivered within the indicated delivery period, we will contact you. Please ensure that you provide the correct telephone number and e-mail address.

Article 7 – Right of Withdrawal / Returning a Product

Customers of American Sportstore have the right to return a product within 30 days. To do so, please complete our return form within 30 days of receiving your order. Upon receipt of your return request, we will assess whether your product qualifies for return. Once your return has been approved, the product must be received by American Sportstore within 14 days. The costs of returning a product are the responsibility of the customer.

7.1 Conditions for Returning Your Product:

-Product is undamaged;
-Unworn and in its original packaging – Where reasonably possible;
If the product is damaged or the packaging is damaged more than necessary to inspect the product, we may deduct the resulting loss in value from your refund. Please handle the product with care and ensure that it is properly packaged when returning it.
-A return request has been submitted within 30 days of receipt;
Personalised products cannot be returned.

7.2 Incorrect Product Received

If the customer receives an incorrect product, meaning a product different from the one ordered, American Sportstore will exchange it for the correct or a comparable product. The customer must contact our customer service in writing within 30 days of receiving the order. If we determine that we have shipped the wrong product, we will reimburse the customer's shipping costs.

7.3 Return Options

If your return is approved by American Sportstore, the customer may choose one of the following options:

7.3.1 Refund

The amount due will be refunded within 14 calendar days after American Sportstore has received the returned product.

7.3.2 Replacement Product

You will receive the same or the correct product after we have received and inspected the returned product. Shipping costs for a second shipment will be charged to the customer, unless you received an incorrect or damaged product.

Article 8 – Exclusion of the Right of Withdrawal

The following products are excluded from the right of withdrawal:

Products made according to the consumer's specifications, which are not prefabricated and are manufactured based on an individual choice or decision of the consumer, or which are clearly intended for a specific person;

Items that are not in their original condition and/or original packaging.

Items that have been worn or used.

Items for which the consumer has accepted a personalised quotation.

Article 9 – Warranty

If the customer receives a damaged product, American Sportstore will exchange it for the same or a comparable product. To do so, the customer must contact our customer service (info@american-sportstore.com) within 30 days of receiving the product. If we determine that we have shipped a damaged product, we will reimburse the customer's shipping costs.

A manufacturer's warranty applies to shoes purchased from American Sportstore. The manufacturer's warranty period is 60 days from the date of receipt of the product. The manufacturer's warranty may be invoked if a shoe is damaged to such an extent that it can no longer reasonably be used for walking. In such cases, a replacement pair of shoes will be offered or the costs of repair by a professional shoe repair service will be reimbursed by American Sportstore.

Any right to warranty becomes void if the shoes have been used in ways or in locations for which they were not intended.

Article 10 – Complaints

All agreements are governed by Dutch law. The competent Dutch court shall have jurisdiction over any disputes arising from the agreement between American Sportstore and the other party, without prejudice to the jurisdiction of any other competent authority.

Complaints regarding your order must always be submitted to us in writing within 14 days. If this does not lead to a satisfactory solution, you may submit your dispute for mediation through Stichting WebwinkelKeur via https://www.webwinkelkeur.nl/kennisbank/consumenten/geschil.

From 15 February 2016, consumers within the European Union may also submit complaints through the European Commission's Online Dispute Resolution (ODR) platform. The ODR platform can be found at http://ec.europa.eu/odr. If your complaint is not already being handled elsewhere, you are free to submit it through the European Union's platform.

Article 11 – Failure to Comply with Our Terms and Conditions

If a customer of American Sportstore fails to comply with these Terms and Conditions as set out above, any right to exchange, return or receive a refund for an order shall be forfeited. American Sportstore reserves the right to charge the customer for any costs incurred in relation to the order.
